- In the name of God Amen the sixteenth day of June 1645 I Marmaduke Rutter of Sawley in the Countie of York, Taylor, being sick in body but of perfect remembrance, God be praised, do here ordain and make this my will and testament in manner and form following.
------- first and most especially I give and bequeath my soul to almighty god my maker hoping assuredly that by the death and passion of Jesus Christ my saviour to be redeemed from all my sins and my body to buried in the churchyard of Ripon or elsewhere at the discretion of my friends.
Item I give and bequeath unto my five{?] daughters each one of them six pounds to be paid within twelve months after my death.
Item I give and bequeath unto my son John twentie shillings to be paid him by yearly dowager my son Thomas the ------- of twentie years if her him for long at --------- of Butiosh St. Martin the Bishops in winter by --------- and equal portion ----------------- I purchased of Francis S------ deceased and it to ------- until the said annuity is --fully paid. And my mind is that my son Thomas do teach and ------- him the taylor trade and to maintain him with ------- -------- Glohs and all other ------ until he come to the age of eighteen years if they for longer ----- --------.
Item I give and bequeath unto my daughter Janitt our tithe house called the Barthouse[?], provided that my son Thomas and my wife may make use of the oven[?] when they shall have need at their ----.
----- the rest of my goods my debts and funeral expenses being paid I give and bequeath unto my executor and I ordain and make Margritt my wife sole executor of this my last will and testament.

- Will written 16/6/1645.
- By the Treaty of Ripon, signed 14th October 1640, negotiations between Charles I and the Scots army for a permanent settlement were adjourned to London, but meanwhile the Scots were to occupy Co. Durham and Northumberland. The army was to be paid £850 a day maintenance during the occupation, and the Scots provisional government was to be reimbursed its expenses in prosecuting war against the King.
